Extracts from the Building permit by-law (#2009-011)

In conformity with article 2.1.1 of Permit By-law #2009-011, all fees must be paid at the opening of the application. Incomplete applications will be refused.

Permit by-law extracts

Working hours

No construction shall be carried out:

  1. between the hours of 7:00 p.m. and 7:00 a.m. from Monday to Friday
  2. between the hours of 7:00 p.m. and 9:00 a.m. on Saturdays
  3. between the hours of 7:00 p.m. and 10:00 a.m. on Sundays

Security fences/barricades

Prior to commencing any work related to a project including, without limitation, any excavation whatsoever of the site, and to ensure public safety, a strongly constructed fence, boarding or barricade forming a solid enclosure, not less than 1.8m (6 feet) in height, shall be erected on all construction sites between the project and the public way and all open sides of the site. In addition, said fence, boarding or barricade shall be maintained at all times for the duration of the work and shall be removed only upon receiving the approval of the Town.

Responsibility and obligation

Any person who fails to comply with any order or notice issued by the Building Inspector, or who allows a violation of these requirements to continue, contravenes the provisions of the by-law. No persons shall deviate from the plans and specifications for which a building permit was issued, or omit or fail to complete, prior to occupancy, work required by the said plans and specifications accepted by the Building Inspector without first obtained in writing, the approval of the Building Inspector to do so. Notwithstanding anything herein contained, neither the Town nor any of its employees shall be responsible for any damages resulting from any act of omission in enforcing or failing to enforce any or all of the provisions of the by-laws.


Obligations of the owner

No person shall commence or continue any project for the construction, alteration, enlargement or extension of a building without first obtaining a building permit. Every owner shall provide an up-to-date survey of the building site when required by the Building Inspector. When required by the Building Inspector, every owner shall uncover and replace at his own expenses any work that has been covered contrary to an order issued by the Building Inspector. Before excavation for any foundation is begun, obtain from the Director of Public Works, the location of the sewer and water mains and of the building drain and water service pipe if any. Give at least 48 hours notice to the Building Inspector of the intention to start work on the building site.

Obligations of the contractor

Contractors are responsible for ensuring that no excavation or other work is undertaken on public property and that no building is erected or materials stored in whole or in part thereon without approval having first been obtained in writing from the appropriate government authority. The contractor shall ensure compliance with all construction safety requirements at all times.


Occupancy permit requests

The following must be submitted along with the application for an occupancy permit:

  1. Scaled drawings (minimum 1/8″=1′-0″) are to be submitted, indicating floor areas, rooms, over all dimensions and required fire exits.
  2. Where the use of toxic and/or hazardous materials is being used, a list of these materials shall be submitted.
  3. A copy of the lease between owner and tenant or, if the lease is not available, the following information:
    1. The floor area, in square feet
    2. Total annual rent
    3. Duration of lease
    4. Services included in lease

An Occupancy Permit will not be issued until the above information has been submitted.
